Welcome to iSmoke, a THC product delivery service operating in South Africa. By using our services, you agree to comply with and be bound by the following Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

1. Nature of Service

iSmoke provides a delivery service for THC products purchased from legally licensed dispensaries. We do not sell, distribute, or manufacture THC or any cannabis-related products. Our role is strictly to facilitate the delivery of products that customers have purchased directly from licensed stores.

2. Eligibility

To use our services, you must be:

  • At least 21 years of age.
  • A resident of South Africa.
  • Legally permitted to purchase and possess THC products under South African law.
  • Must provide a South African ID for the Delivery Man to take a picture when receiving your delivery. If not availible delivevry will not be completed

By placing an order for delivery, you confirm that you meet these eligibility requirements.

3. User Responsibilities

  • You must ensure that all information provided to iSmoke is accurate and up to date.
  • You must use our services in compliance with all applicable South African laws and regulations, including those related to the possession and use of cannabis.
  • You are solely responsible for ensuring that the delivery location is safe, lawful, and accessible.
  • You must not use our service to purchase or receive products on behalf of any third party.

4. Order Process

  • Orders are placed directly with the participating dispensaries listed on our platform.
  • iSmoke will only facilitate the delivery of these products from the dispensary to your specified address.
  • All orders are subject to availability and acceptance by the dispensary.
  • Once an order is confirmed, it cannot be canceled or modified through iSmoke. Please contact the dispensary directly for any changes.

5. Delivery Policy

  • iSmoke offers delivery services to specified areas within South Africa.
  • Delivery times are estimated and may vary due to traffic, weather, or other unforeseen circumstances.
  • You must be present at the delivery location to receive the order. Identification verifying age and identity will be required upon delivery.
  • If you are not present at the delivery address, or if we are unable to verify your identity, the delivery will not be completed, and you may be charged a fee.

6. Payment Terms

  • Payment for delivery services must be made in accordance with the payment options provided on our platform.
  • All prices and fees are in South African Rand (ZAR) and include VAT unless otherwise stated.
  • iSmoke is not responsible for any pricing errors that may occur on the dispensary's side.

7. Liability and Indemnification

  • iSmoke is not liable for any damages, losses, or injuries arising from the use or misuse of cannabis products delivered through our service.
  • iSmoke is not responsible for the quality, safety, legality, or suitability of the products ordered from dispensaries.
  • You agree to indemnify and hold iSmoke harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of our service or violation of these Terms and Conditions.

8. Prohibited Conduct

  • You must not use our services for any unlawful or fraudulent purposes.
  • You must not interfere with the proper functioning of our platform or attempt to gain unauthorized access to any systems or networks related to our services.

9. Changes to Terms and Conditions

iSmoke reserves the right to modify these Terms and Conditions at any time. Changes will be posted on our website, and continued use of our services after changes are posted will constitute your acceptance of the revised terms.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of South Africa. Any disputes arising from these terms or the use of our services will be subject to the exclusive jurisdiction of the courts of South Africa.
